Giver LLC ("Giver," "we," "us," or "our") provides this Privacy Notice ("Notice") to explain how we collect, use, and disclose information about you when you use giverstories.com, our mobile experiences, and related services (the "Services").
Giver is a video-first giving platform: campaigns are built around a story video, a thank-you video, and an impact video, and these videos are central to how Giver operates and promotes the Platform, including by sharing them across social media. Because of that, this Notice pays special attention to how we handle video, photo, and likeness information, in addition to the account, payment, and usage information typical of an online platform.
Please read this Notice carefully. By using the Services, you acknowledge that you have read and understood how we collect, use, and disclose information as described here. This Notice should be read together with our Terms of Service, which governs your use of the Platform generally.
1. Information We Collect
1.1 Information You Provide Directly
We collect information you give us directly, including when you:
- Create an Account, including your name, email address, phone number, and password.
- Create a campaign, including your story, photos, videos, location, the need you're describing, and any documentation you provide to verify it.
- Record or upload a thank-you video or an impact video.
- Give to a campaign or the General Fund, including your name, billing details, and any message you leave.
- Set up a payout method as a Recipient, including bank account or payout details you provide to Stripe.
- Communicate with us or other Users, including support requests, campaign updates, and comments.
- Sign up for our email list or otherwise ask to hear from us.
This may include sensitive information you choose to share as part of your story, such as information about your health, housing situation, immigration status, financial hardship, or other circumstances motivating your campaign. If you include this information in a public campaign, you are choosing to make it public, and we and other Users will process it as described in this Notice.
1.2 Video, Photo, and Likeness Information
Because Giver is video-first, most campaigns include a video or photo of the Recipient, and often of other people connected to their story. This content typically includes someone's face, voice, and name, which may be considered biometric or likeness information under some state laws.
We collect this content when you upload or record it through the Platform. We do not use facial recognition or voiceprint technology to identify people from campaign videos ourselves. If Stripe uses this type of technology as part of identity verification, that processing is governed by Stripe's own privacy practices, described in Section 1.4 below.
1.3 Information We Collect From Other Parties
We may receive information about you from:
- Stripe, our payment processor, including verification results, transaction data, and fraud signals.
- Affiliate Partners who submit or vouch for a campaign on a Recipient's behalf.
- Social media or login providers, if you choose to log in or connect a social account, such as Google.
- Vendors who help us verify identity, prevent fraud, or improve the Platform.
1.4 Identity Verification and Payment Information
We use Stripe to process donations and payouts and to verify the identity of Recipients before releasing funds. Stripe may collect a copy of a government-issued ID and use identity verification technology, which may include a selfie or facial matching, to confirm identity. Giver does not itself collect or store this biometric verification data; it is collected and retained by Stripe, subject to Stripe's own privacy policy and retention practices, available at stripe.com/privacy. We receive only the verification result (such as pass or fail) from Stripe, not the underlying biometric data.
1.5 Information Collected Automatically
- Device and browser information, such as IP address, browser type, operating system, and device identifiers.
- Location information inferred from your IP address, or your precise location if you grant permission through your device settings.
- Usage information, such as pages viewed, links clicked, and time spent on the Platform.
- Cookies and similar technologies, described further in Section 5.
2. Your Videos and Campaign Content
When you submit a story video, thank-you video, impact video, photo, or other content to Giver ("Your Content"), you retain ownership of it. To let us operate and promote a video-first platform, you grant Giver a non exclusive, worldwide, perpetual, irrevocable, royalty free, sublicensable license to host, reproduce, edit, distribute, publicly display, and otherwise use Your Content, in whole or in part, on the Platform and in Giver's own marketing and promotion, across any medium now known or later developed, including social media platforms such as YouTube, Instagram, TikTok, Facebook, and X. This license is described fully in our Terms of Service and applies regardless of whether a campaign is later removed, completed, or closed.
This means a video or photo you submit may be published on a campaign page, shared to Giver's own social accounts, used in Giver's advertising, or provided to press or partners to promote a campaign or the Platform generally, at Giver's discretion.
Because campaign content is designed to be public, please don't include information in your story or video that you don't want the public to see. If your video or photo includes other people, you're responsible for making sure you have their permission to share it with us on the terms described here.
If you want a video or photo removed from active promotion, contact us at hello@giverstories.com. We'll evaluate the request, but content already published to a third-party platform such as YouTube or Instagram may remain available on that platform even after we stop actively promoting it, subject to that platform's own tools and policies.
3. How We Use Information
We use the information we collect to:
- Operate the Platform, including creating and displaying campaigns, processing donations, and paying out funds.
- Verify identity and prevent fraud, in coordination with Stripe.
- Communicate with you about your Account, a campaign, or a donation.
- Publish and promote campaigns and the Platform, including on social media, as described in Section 2.
- Improve and develop the Platform.
- Send marketing communications, where you haven't opted out.
- Comply with legal obligations and enforce our Terms of Service.
- Protect the rights, property, and safety of Giver, our Users, and the public.
4. How We Share Information
4.1 Public Campaign Content
Campaign pages, including a Recipient's name, story, location, photos, videos, and funding progress, are public by default and visible to anyone, including search engines and people without a Giver account. Donor names and amounts are shown on the campaign's public activity feed unless you choose to give anonymously; even then, your name and donation details remain visible to the Recipient and to Giver.
4.2 Payment Processors
We share information necessary to process a donation or payout with Stripe. Stripe acts as an independent controller of the information it collects directly, in addition to processing on our behalf. Review Stripe's privacy policy at stripe.com/privacy to learn more.
4.3 Social Media and Video Platforms
As described in Section 2, we publish campaign videos to social platforms such as YouTube, Instagram, TikTok, Facebook, and X as part of operating and promoting Giver. Once content is on those platforms, its handling is also governed by that platform's own privacy policy and terms, which we don't control. If you connect a social account to log in to Giver, that provider will share the information you've permitted it to share with us, and its own privacy policy applies to its handling of your data.
4.4 Recipients, Affiliate Partners, and Donors
- If you donate to a campaign, we share your name, message, and donation details with the Recipient (or the Affiliate Partner managing the campaign, where applicable), who may see and, in some cases, respond to you.
- If you run a campaign through an Affiliate Partner, we may share relevant campaign and verification information with that partner so they can vouch for your story.
- Recipients and Affiliate Partners are responsible for how they use information we share with them, subject to their own agreements with Giver.
4.5 Vendors and Service Providers
We share information with vendors who perform services for us, such as hosting, analytics, customer support, identity verification, and fraud prevention, under obligations consistent with this Notice.
4.6 Legal and Safety Reasons
We may disclose information to comply with a legal obligation, respond to a subpoena or court order, investigate suspected fraud or illegal activity, enforce our Terms of Service, or protect the rights, property, or safety of Giver, our Users, or the public.
4.7 Business Transfers
If Giver is involved in a merger, acquisition, financing, or sale of assets, information we hold may be transferred as part of that transaction, subject to this Notice or a successor notice.
4.8 Aggregated and De-Identified Data
We may aggregate or de-identify information so it no longer identifies you, and use or share that data for any purpose, including research and improving the Platform.
4.9 We Do Not Sell Your Personal Information
Giver does not sell personal information for money. We also do not share personal information for cross-context behavioral advertising as those terms are defined under state privacy laws. If that changes, we will update this Notice and provide the choices required by applicable law.
5. Cookies and Similar Technologies
We and our vendors use cookies and similar technologies to operate the Platform, remember your preferences, understand how the Platform is used, and, where applicable, measure the performance of our marketing. This may include analytics tools such as Google Analytics.
You can control cookies through your browser settings. Blocking non-essential cookies is generally possible, but essential cookies can't be disabled because the Platform depends on them to function. If your browser sends a Global Privacy Control or similar opt-out signal, we will honor it as a request to opt out of sale or sharing to the extent required by applicable law.
6. Third-Party Services and Links
The Platform links to and integrates with third-party services, including Stripe, Amazon, Wise, mobile money providers, and social media platforms. These third parties have their own privacy policies, and we encourage you to review them. We are not responsible for the privacy practices of third-party services, even where content originally submitted to Giver is shared to or through them.
7. Children
The Services are not directed to and are not designed for use by anyone under 18. If you are under 18, please do not use the Platform or submit information to us. If we learn that someone under 18 has provided personal information, we will delete it to the extent required by law. If you believe a child has used the Platform, contact us at hello@giverstories.com.
8. Data Security
We use reasonable technical and organizational measures designed to protect information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. No method of storage or transmission is completely secure, and we can't guarantee absolute security.
9. Data Retention
We retain information for as long as needed for the purposes described in this Notice, including operating the Platform, maintaining campaign records, meeting legal and tax obligations, and resolving disputes. Because campaign videos and pages serve as an ongoing public record of what happened with a gift, they may remain accessible after a campaign is complete unless removal is required by law or approved at our discretion.
10. International Data Transfers
Giver is based in the United States and our Services are hosted here. If you use the Platform from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.
Some Recipients are located outside the United States and receive payouts through international transfer providers such as Wise or mobile money services. Sending an international payout necessarily involves sharing the Recipient's name and payout details with the relevant provider and, where applicable, financial institutions in the Recipient's country.
11. Your Privacy Rights
Depending on where you live, you may have rights under state privacy laws, including those of California, Colorado, Connecticut, Utah, Virginia, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Maryland, Minnesota, and Tennessee. Availability of these rights depends on your state of residence and the law in effect there. Depending on your state, you may have the right to:
- Know what categories of personal information we've collected about you and why.
- Access a copy of the personal information we hold about you.
- Correct inaccurate personal information.
- Delete personal information we hold about you, subject to legal exceptions.
- Opt out of the sale of personal information or its use for targeted advertising (Giver does not currently do either, as described in Section 4.9).
- Appeal a decision we make in response to your request.
To exercise these rights, email us at hello@giverstories.com with your request and your state of residence. We may need to verify your identity before acting on a request, and we may decline requests to the extent permitted by law, for example where we need information to comply with a legal obligation or to keep records related to a completed transaction.
If you are a Utah resident, you have rights under the Utah Consumer Privacy Act. As a Utah-based company, we take that seriously and will process Utah requests consistent with this Notice. If you are a Nevada resident, you may opt out of the sale of certain information by contacting us; we do not currently sell information as defined under Nevada law.
12. Changes to This Notice
We may update this Notice from time to time. If we make a material change, we will post the updated Notice on the Platform and update the "Last Updated" date above. Continuing to use the Platform after a change takes effect means you accept the updated Notice.
